Tasmania Supreme Court Issues Generative AI Guidelines
The Supreme Court of Tasmania issued guidelines for generative AI use that took effect on October 21, 2026, Australasian Lawyer reports. The rules apply to lawyers, litigants, witnesses, third parties, and other users who prepare documents for court proceedings.
Users must verify all material prepared with generative AI before submitting it. They must also be ready to identify the tools used, explain how they used them, and describe the checks performed. The court does not require users to certify their use of generative AI, while expert witnesses must disclose use in line with the Expert Witness Code of Conduct.
The court identifies greater risks when generative AI is used for pleadings, written submissions, document lists, affidavits, expert reports, or material containing confidential, suppressed, or private information. Failure to follow the guidelines, court orders, or directions may delay proceedings. Lawyers may also be referred to the Legal Profession Board of Tasmania.
